These Terms of Service govern your use of the Beloved Prints website and your purchase of products from Beloved Prints.

The website and store are operated by Southern 54, LLC, doing business as Beloved Prints. Throughout these Terms, “Beloved Prints,” “we,” “us,” and “our” refer to Southern 54, LLC, DBA Beloved Prints.

By accessing our website, submitting information, creating an account, or purchasing a product, you agree to these Terms of Service and to the other policies published on our website, including our Return and Refund Policy, Shipping Policy, and Privacy Policy.

1. Eligibility and lawful use

You may use our website only for lawful purposes.

You must not use our website, products, or services to:

• Violate any applicable law or regulation
• Commit or facilitate fraud
• Infringe another person's intellectual-property, privacy, publicity, or other legal rights
• Upload or transmit malware, malicious code, or harmful material
• Attempt unauthorized access to our website, accounts, systems, or data
• Interfere with the operation or security of our website
• Submit false, deceptive, or fraudulent information
• Engage in abusive, threatening, or harassing conduct

By placing an order, you represent that you are legally capable of entering into a binding agreement or are acting with the authorization of a parent or legal guardian where permitted by law.

2. Product information

We make reasonable efforts to describe and display our products accurately.

Beloved Prints sells both standard products and custom or personalized products. Many of our products are produced using 3D printing, painting, finishing, or other processes that can result in minor variations between individual pieces.

Differences may occur between:

• Online photographs and finished products
• Digital previews and physical products
• Separate production runs
• Filament, resin, paint, or material batches
• Screen-displayed colors and physical colors
• Hand-painted or hand-finished details

Product dimensions, weights, colors, and measurements are approximate unless expressly stated otherwise.

Minor variations associated with normal manufacturing, 3D printing, or hand-finishing processes do not necessarily constitute defects.

3. Custom and personalized products

Certain Beloved Prints products are created using customer-provided photographs, names, text, measurements, specifications, or other personalization information.

Custom models, sculptures, busts, figurines, and similar products may involve artistic interpretation.

A finished custom product may not reproduce every:

• Facial feature
• Hairstyle
• Expression
• Texture
• Proportion
• Garment
• Accessory
• Animal marking
• Color
• Photographic detail

exactly as it appears in a reference image.

The quality and accuracy of a custom product depend significantly on the quality, clarity, angle, lighting, completeness, and accuracy of the reference materials supplied by the customer.

Unless expressly included in the product description or otherwise agreed in writing, the purchase price does not guarantee:

• Photorealistic likeness
• Exact anatomical duplication
• Exact color matching
• Unlimited revisions
• A customer preview before production
• Reproduction of details that are not visible in supplied reference materials

Custom and personalized products are subject to the additional terms contained in our Return and Refund Policy.

4. Customer-provided photographs and content

By uploading, sending, or otherwise providing photographs, names, text, logos, artwork, designs, or other content to Beloved Prints, you represent that:

• You own the content or have permission to use it
• You have the authority to authorize its use in connection with your order
• Its use does not violate another person's copyright, trademark, privacy, publicity, or other rights
• The content is lawful
• The content does not contain material that you are prohibited from providing to us

You grant Beloved Prints a limited, nonexclusive license to use submitted content only as reasonably necessary to:

• Review your request
• Communicate with you
• Create or prepare your product
• Produce and fulfill your order
• Provide customer service
• Resolve disputes or claims relating to the order

Beloved Prints may decline, suspend, or cancel a request that we reasonably believe is illegal, fraudulent, abusive, technically infeasible, unsafe, infringing, or otherwise inappropriate.

5. Intellectual property

Unless otherwise stated, the Beloved Prints website, branding, original photographs, graphics, text, logos, product designs, digital models, production files, and other original materials are owned by or licensed to Beloved Prints and are protected by applicable intellectual-property laws.

Purchasing a physical product does not transfer ownership of:

• Copyrights
• Trademarks
• Digital models
• STL or other model files
• Source files
• Production files
• Design files
• Commercial reproduction rights

unless expressly agreed to in writing.

You may not copy, reproduce, distribute, reverse engineer, extract, resell, or commercially exploit our digital designs, production files, website content, or other protected materials without written authorization.

6. Orders

All orders are subject to acceptance by Beloved Prints.

We reserve the right to reject, limit, suspend, or cancel an order for legitimate reasons, including:

• Suspected fraud
• Pricing or listing errors
• Product unavailability
• Inventory problems
• Technical limitations
• Prohibited or unlawful content
• Intellectual-property concerns
• Inability to complete a requested customization
• Incorrect or incomplete customer information
• Payment problems

An automated order confirmation does not necessarily constitute final acceptance of an order.

If we cancel all or part of an order before fulfillment, we will refund the applicable amount paid for the canceled portion.

7. Prices and payments

Prices are shown in the currency displayed during checkout.

Applicable taxes, shipping charges, duties, and other fees will be displayed during checkout when required.

We may change product prices at any time. A later price change will not normally affect an order that has already been accepted.

Payments are processed through Shopify and available third-party payment providers.

Beloved Prints does not directly store complete payment-card numbers.

Customers are responsible for providing accurate billing and payment information.

8. Order cancellations

Orders may be canceled within 24 hours of the original order time by contacting:

support@belovedprints.com

Submitting a cancellation request does not guarantee cancellation unless the request is received within the 24-hour cancellation period.

After the 24-hour period, an order may have entered production, processing, or preparation and cancellation can no longer be guaranteed.

Custom or personalized orders may be particularly difficult or impossible to cancel or modify after production has begun.

Additional cancellation terms are provided in our Return and Refund Policy.

9. Returns, exchanges, and refunds

Returns, exchanges, replacements, cancellations, and refunds are governed by our Return and Refund Policy, which is incorporated into these Terms.

In general:

• Eligible standard, non-personalized products may be returned within the period stated in our Return and Refund Policy.
• Custom and personalized products are not eligible for buyer-remorse returns or exchanges.
• Damaged, materially defective, or incorrect products remain eligible for review regardless of whether the product was customized.

Customers must follow the return authorization and claim procedures stated in our Return and Refund Policy.

10. Processing, production, and shipping

Our normal processing or production time is approximately 5 to 7 business days before shipment, unless another timeframe is stated on the product page, during checkout, or otherwise communicated to the customer.

Processing and production time is separate from carrier transit time.

Certain products may require additional production time because of:

• Customization
• Hand painting or finishing
• Complexity
• Product size
• Order quantity
• Customer-supplied materials or photographs
• Periods of unusually high demand

Shipping methods, tracking, delivery estimates, damaged shipments, lost packages, address errors, returned packages, and international shipping are governed by our Shipping Policy.

11. Customer responsibility for order information

Customers are responsible for reviewing all information submitted with an order before completing checkout.

This includes:

• Product selections
• Size
• Color
• Quantity
• Names
• Spelling
• Personalization
• Measurements
• Uploaded photographs
• Shipping address
• Billing information
• Other customer-provided specifications

Beloved Prints is not responsible for errors in a finished custom product that result directly from incorrect, incomplete, or inaccurate information supplied by the customer.

12. Safety and product use

Customers are responsible for using Beloved Prints products safely and appropriately.

Unless a product is expressly advertised for a particular use, our products:

• Are not toys
• May contain small parts
• Should be kept away from unsupervised children and pets
• Are not intended for food contact
• Are not intended for medical use
• Are not intended for structural or protective use
• Are not intended for life-safety applications
• Should not be exposed to open flames
• Should not be exposed to excessive heat
• May deform, discolor, fade, or weaken when exposed to high temperatures, prolonged direct sunlight, moisture, or unsuitable outdoor conditions

If a product is designed to hold a decorative tealight, use battery-powered LED tealights only unless the product description expressly states otherwise.

Never use a real candle or open flame in a 3D-printed product unless the product is specifically designed and expressly approved for that use.

13. Third-party services

Our website and store may use or link to third-party services, including:

• Shopify
• Payment processors
• Shipping carriers
• Analytics providers
• Advertising platforms
• Social-media platforms
• Email and marketing providers
• Product-option or customization applications

These third parties operate independently and may have their own terms, privacy policies, and practices.

To the extent permitted by law, Beloved Prints is not responsible for the independent availability, security, accuracy, policies, or conduct of third-party services.

14. Reviews, comments, and feedback

If you submit a review, comment, suggestion, testimonial, or other non-confidential feedback, you grant Beloved Prints permission to use, reproduce, edit, publish, and display that material for lawful business purposes.

You represent that content you submit does not violate another person's rights and is not unlawful, defamatory, threatening, deceptive, malicious, obscene, fraudulent, or infringing.

We reserve the right to remove content that violates these Terms or applicable law.

15. Errors and inaccuracies

Our website may occasionally contain:

• Typographical errors
• Incorrect pricing
• Incorrect product descriptions
• Outdated information
• Inventory inaccuracies
• Technical errors
• Omissions

We reserve the right to correct errors and update information without prior notice.

If an error materially affects an existing order, we may contact the customer and provide reasonable options, including correcting or canceling the affected portion of the order where appropriate.

16. Prohibited conduct

You may not:

• Commit or facilitate fraud
• Submit false or misleading information
• Upload malicious software or harmful code
• Attempt unauthorized access to systems or accounts
• Scrape or harvest data without authorization
• Circumvent website security
• Infringe intellectual-property rights
• Violate another person's privacy or publicity rights
• Harass or threaten our personnel
• Use our products or services for unlawful purposes

We may restrict access to our website or services when we reasonably believe these rules have been violated.

17. Disclaimer of warranties

To the fullest extent permitted by applicable law, our website and products are provided on an “as available” and “as is” basis except where we expressly provide a written warranty.

We do not guarantee that:

• The website will always be available
• The website will operate without interruption
• The website will be completely error-free
• Every product will appear exactly as displayed on every screen or photograph

Nothing in these Terms excludes warranties, remedies, or consumer rights that cannot lawfully be excluded or limited.

18. Limitation of liability

To the fullest extent permitted by applicable law, Southern 54, LLC, DBA Beloved Prints, will not be liable for indirect, incidental, special, exemplary, punitive, or consequential damages arising from use of the website, products, or services.

Where liability cannot lawfully be excluded, our aggregate liability relating to a product or order will not exceed the amount paid for the product or order giving rise to the claim, except where applicable law requires otherwise.

Nothing in this section limits liability that cannot legally be limited.

19. Indemnification

To the extent permitted by applicable law, you agree to indemnify and hold harmless Southern 54, LLC, DBA Beloved Prints, and its owners, employees, personnel, contractors, and service providers from claims, losses, liabilities, damages, or reasonable expenses arising from:

• Your violation of these Terms
• Your unlawful use of the website or products
• Content or materials you supplied
• Your violation of another person's intellectual-property, privacy, publicity, or other legal rights

20. Severability

If any provision of these Terms is determined to be invalid, unlawful, or unenforceable, that provision will be enforced to the maximum extent permitted by law and the remaining provisions will remain in effect.

21. No waiver

Our failure to enforce any provision of these Terms does not waive our right to enforce that provision or any other provision later.

22. Entire agreement

These Terms, together with the policies referenced in them and any additional terms presented during checkout or on a specific product page, constitute the agreement governing your use of our website and purchase of our products.

If a product page contains terms that are more specific to that product, those product-specific terms apply to that product to the extent they do not conflict with applicable law.

23. Governing law

These Terms are governed by the laws of the State of Florida and applicable United States federal law, without regard to conflict-of-law principles.

Subject to any rights or protections that cannot lawfully be waived, disputes relating to these Terms will be handled by an appropriate court having jurisdiction in Brevard County, Florida.

Nothing in this section deprives a consumer of protections or legal rights that cannot lawfully be restricted.

24. Changes to these Terms

We may update these Terms from time to time.

The current version will be posted on our website with an updated “Last updated” date.

Changes apply prospectively unless applicable law requires otherwise.
